Probation Period Rules & Termination Rights in India

A guide to understanding your rights, notice periods, and termination clauses during a probation period in India.

When you join a new company in India, you are typically placed on a probation period before being confirmed as a permanent employee. The probation period is essentially a trial phase, usually lasting between 3 to 6 months (though it can extend up to a year in some organizations), during which the employer evaluates your skills, cultural fit, and overall performance.

Termination During Probation: The most critical aspect of the probation period is the ease of termination. Unlike confirmed employees, individuals on probation do not enjoy the same level of job security. In India, an employer has the legal right to terminate an employee during their probation period without assigning any specific reason, provided it is stated in the employment contract. The company simply has to state that your performance or conduct was "unsatisfactory."

Notice Period Rules: The notice period during probation is significantly shorter than for confirmed employees. In most Indian IT and corporate firms, the notice period during probation ranges from 15 days to 30 days. This works both ways: the company can ask you to leave by giving you a 15-day notice (or pay in lieu of notice), and similarly, you can resign by serving a short 15-day notice if you feel the job isn't the right fit for you.

Confirmation Process: It is a common misconception that an employee is automatically confirmed once the stated probation period ends. Under Indian labor laws, confirmation is not automatic unless explicitly mentioned in the appointment letter. Usually, the employer must issue a formal letter of confirmation. If they do not issue a letter, your probation may be deemed to be implicitly extended.

Leaves and Benefits: During probation, employees are typically only entitled to casual and sick leaves. Earned leaves (privilege leaves) are usually accrued but cannot be availed until the employee is confirmed. Additionally, certain benefits like company-sponsored health insurance might only activate post-confirmation, depending on the company's HR policies. Always read your offer letter meticulously to understand the specific conditions governing your probation.
